Terms and Conditions For Hire and Buy

To Hire General

 

If you feel unable to accept any of these terms and conditions you may cancel this order within 48 hours of the Order Date and receive a full refund, including your deposit, unless the Fitting or Function Date is within seven days of the Order Date. Deposits are non-refundable if the order is cancelled more than 48 hours after the Order Date.

 
What we will provide:
 
 
Garments as detailed on your order as long as they are within the size range available. Please note that it is not possible to carry out alterations to garments as you might expect if you had purchased them.
All garments are quality checked and processed after each hire and every effort is made to ensure the quality is to a high standard and that garments are free from any defects. However, due to dry-cleaning there may be a slight shading difference in garments, especially where garments are ordered for a large wedding party.
We reserve the right to substitute to the nearest half size as follows:

What we expect expect of you:

 
1. Booking
  • Customer must be measured at the shop of collection, otherwise no responsibility will be taken for discrepancies. (It is the customer's responsibility to check that all the details on the order (e.g. function date, garments etc.) are correct.
  • The hire period is deemed to start from 9am on the function date. If hires are required earlier than the normal fitting date an additional charge of 50% per week or part week is payable.
2. Deposit
A minimum deposit of 50% of the total hire charge must be paid on booking.
3. Changes to Original Order
We reserve the right to make the following charges to you for changeovers to your order. £2 will be charged per garment for any change made against the original order, unless due to condition 4 (g).
4. Fitting
  • The Hirer is urged to confirm that his order is in the branch prior to travelling in the unlikely event that there have been unforeseen delays in the delivery of orders.
  • The Hirer must attend the Shop of Collection on the Fitting Date and try on all garments to ensure they fit.
  • If the fit is not satisfactory please report this to us immediately or not later than 12 noon on the day following the Fitting Date.We cannot accept any responsibility if you fail to do this.
  • If garments do not fit satisfactorily or have any other fault further visits to the shop will be necessary. All replacements must be inspected and tried on by the Hirer (or other member of the Hirer's party) at the shop. Goods will be delivered only to the shop of original order for checking and trying on by the Hirer or party member.
  • Failure of the Hirer or party member to request the replacement of any item within the time stated above (see clause 4c) will result in additional carriage charges, payment of which will be the responsibility of the Hirer.
  • It is the responsibility of the Hirer or party member to meet their own expenses (e.g. travel costs, time off work, etc.) incurred during this fitting and collection process even if the garment has a fault.
  • As children's size change quite significantly whilst they are growing the Hirer should arrange to re-measure 4 weeks prior to the function to confirm the sizes required.This allows plenty of time to amend the order if necessary. It is not uncommon for children's garments to need several fittings.
5.Cancellation of Order
  • In the event of an order being cancelled within 48 hours of the Order Date the deposit will be refunded in full unless conditions (5c) below applies.
  • In the event of an order being cancelled more than 48 hours after the Order Date the deposit is non-refundable.
  • In the event of the order being cancelled within one week before the Fitting Date you will be required to pay the full cost for each suit ordered.
6. Group Bookings
  • Payment: Each order must be paid for at the branch where the order was placed.
  • Fitting/Collection: These must be done at the local branch at which the wearer placed the order.
  • Return of Garments: All garments must be returned to the shop at which the order was placed.
  • If one member of the group is collecting other party member orders, they will be held responsible for any damage or loss to any of the garments contained within the orders he has collected.
We will not be liable for any issues relating to the timely supply of outfits if the above requirements are not met.
7. Collection of Garments
  • The Hirer is urged to confirm prior to travelling to the store at which he ordered his outfit in order to check that his order has arrived in case of any unlikely delay due to unforeseen circumstances.
  • When you have had your fittings and any necessary replacements have also been tried on and found to be satisfactory the outfit is then deemed to be available for collection.
  • It is the Hirer's responsibility to inform the shop, when booking, if the outfits are required before the Function Date. The Hirer is responsible for checking that the fact is stated on the order form.
8. Extended Hire (before or after the Function Date)
Hire orders may be extended for additional weeks at a rate of 50% of the normal weekly hire charge for additional week or part week. This includes provision for the delivery of orders earlier than the branch normal delivery date.
9. Late Orders
These may be accepted but will be sent out by an independent carrier and the hirer will be liable for any additional costs. We will not accept responsibility for any failure to deliver on time by such third party.
10. Return of Garments
All garments must be returned by the stated Return Date. Failure to do so will result in an excess charge of £6 per suit per day after the stated Return Date. There is no exception to this condition.
11. Care of Garments
  • Please treat the garments with reasonable care.
  • Please take particular care with top hats. Under no circumstances should they be thrown into the air.
12. Lost/Stolen/Maliciously Damaged Items
The Hirer will be responsible for the cost of any hire item that is lost, stolen or maliciously damaged. A full range of charges is available on request.
13. ACCIDENTAL DAMAGE WAIVER
  • Payment of Accidental Damage Waiver by the Hirer covers any charges that would normally arise following accidental damage to any or all of the garments provided that they were being used appropriately (with the exception of Top Hats, which are NOT covered by this waiver).
  • The waiver does not cover garments which have in our opinion been damaged through inappropriate use.
  • Please remember that any personal insurance you may already hold does not cover the garments owned by us.
  • We reserve the right to charge for any garment which is returned damaged (unless covered by our Accidental Damage Waiver). A full list of charges is available on request.
  • The waiver does not cover lost or stolen garments which will be charged for. A full price list of charges is available on request.
14. Security Deposit
A security deposit of £200 per outfit is required (£400 for Highlandwear, cream outfits and overseas visitors). The security deposit is payable by bank cheque or credit card. The security bond is held and is not processed except in the event of non returned or damaged garments not covered by ADW.
15. Data Protection Act 1998
Under the Data Protection Act 1998, we have a legal duty to protect any personal information we collect from you.
  • We will only use personal information you supply to us for the reason that you provided it for.
  • We will only hold your information for as long as necessary to fulfill that purpose.
  • We will not pass your information to any other parties unless this is made clear to you at the time you supplied it.
  • All employees and contractors who have access to your personal data or are associated with the handling of that data are obliged to respect your confidentiality.

If you feel unable to accept any of these terms and conditions you may wish not to use this service. Once your order has been dispatched the full hire cost will be charged.

What we expect of you
1. Booking
Customers are responsible for selecting appropriate sizes at the time of ordering. Any changes of garments due to incorrect selection of sizes will be treated as a new order with corresponding hire, delivery and insurance charges. It is the customer's responsibility to check that all the details on the order (e.g. function date, garments etc.) are correct. The hire period is deemed to start from 9am on the function date.
 
2. Deposit 
No security deposit is required however your authorisation is mandatory (required at the time of booking) that in the event of
non-returned or damaged garments (unless Accidental Damage Waiver cover is taken) that we are authorised to deduct the full
replacement value of the garments directly from your credit or debit card. A full list of costs for replacement garments are available on request.
 
3. Changes to Original Order
Changes to the original order will be treated as a new order with corresponding hire, delivery and insurance charges. It is the customer's responsibility to check that all the details on the order (e.g. function date, garments etc.) are correct.
 
4.Cancellation of Order
All cancellations must be placed by telephone.
Orders cannot be cancelled after 48 hours of the original order being placed without a 50% charge of the full order value
The full hire cost will be charged if orders are cancelled less than 14 days before the function date.
 
5. Deliveries
Garments will be dispatched 4 working days prior to the Function Date using 3rd party couriers on a 48 hour service (orders placed after 12pm on the order date will be processed the following day). Orders are normally delivered within 1 – 2 working days following dispatch between 9am and 5pm for business addresses and 7am and 9pm for home addresses. All orders must be signed for. In the event of the courier being unable to deliver a card giving details of collection arrangements will be left.
We do not accept responsibility for any failure to deliver by and 3rd party carriers.
We will not be liable to you if the Delivery Date is after the date of delivery required by you in the Order if such delay was beyond our reasonable control. In the event of such delay we shall exercise every reasonable effort to deliver the goods as soon as possible.
 
Replacement garments will be dispatched on a third party carrier on a standard 48-hour delivery service (2 working days) at a cost of £9.
Replacement garments requested within 3 working days of the function date will, without exception, be dispatched on an upgraded delivery service, to arrive the following day at supplementary cost of £15.
 
 
6. Returns
If delivery was to a home or business address All garments and accessories must be ready for collection on the first working day after the function date. Collection will be made from the collection address (supplied by you at the time of booking) between 9am and 5.30pm on the collection date by
third party carrier. You will be wholly responsible for ensuring that the garments are ready for collection and are correctly labeled and safely passed to the carrier, whereupon the garments will no longer be deemed to be in your possession (we recommend you retain the consignment note given to you by the carrier and signed by you for up to one month as good
evidence that the collection was successful).
 
In the event of a “failed collection” you will be wholly responsible for contacting us to make alternative arrangements, and will
be liable for any collection costs incurred (£10) and any additional charges for late return (£5 per suit per day after the stated
return date).
 
 
If the garments were collected from a shop they should be returned here the day after the function date. If this does not happen a £10 cost will be incurred per outfit/ part outfit per day until the garments are returned
7. Receipt of Garments
The Hirer is urged to check the garments carefully immediately following receipt. Any faults or errors in the order should be advised to us immediately
We reserve the right to substitute the size of any of the Garments in the Order to the nearest half size as set out below:
Jacket size - - size in Order plus 1 inch
Trouser/kilt waist - - size in Order plus 1 inch
Trouser/kilt length - - size in Order plus 1/2 inch
Top hat size - - size in Order plus 1/8 size
Shoes - - size in Order plus 1/2 size
Collar size - - size in Order plus 1/2 size
 
8. Extended Hire (before or after the Function Date)
Extended hire is not currently available
9. Late Orders
Orders will not be accepted less than 4 working days prior to the Function date.
 
10. Care of Garments
a.                  Please treat the garments with reasonable care. Failure to do so will result in                  additional cleaning or replacement charges.
b.                  You will not modify or alter in any way those garments which have been delivered to you in accordance with the order and you will be liable for all payments and charges made by is in rectifying and / or replacing such garments which are modified
c.                  You agree to notify us immediately in writing of any loss or damage to the garments once you become aware of such loss or damage and be liable to us for the full replacement / repair costs. We will notify you of other losses / damage not notified to us and charge you the full replacement / repair costs.
d.                  You agree as an obligation surviving this agreement to indemnify us in respect of any claims made against us and all damages costs and expenses suffered or incurred by us as a result of any third party claim arising out of the garments or in any way arising out of the garments being let under this agreement.
e. Please be aware that as the Skean Dhu and kilt pin are decorative accessories only, we do not accept any responsibility for any damages, costs,claims, losses, expenses or liability whatsoever incurred by us, and howsoever arising as a result of misuse of the Skean Dhu
and/or kilt pin and you will indemnify us for any such damages, costs, claims, losses, expenses or liabilities. You agree for the
purposes of the Unfair Contract Terms Act 1977 that this liability exclusion is reasonable in the circumstances. In the event that
this condition is deemed unenforceable, that shall not affect the validity or enforceability of any other provision of this contract,
it being the intention of you and us that all conditions of this agreement shall be valid and enforceable.
 
11. Lost/Stolen/Maliciously Damaged Items
The Hirer will be responsible for the cost of any hire item that is lost, stolen or maliciously damaged. A full range of charges is available on request.

e.      The waiver does not cover Top Hats.
f.        Suit carriers, hat boxes and bags are not charged for loan but if not returned carry a £15 charge per item.
 
13. Miscellaneous
This contract is governed by English Law and the English Courts shall have jurisdiction.
